PHOENX TERMS OF SERVICE

These terms apply to your use of wearphoenx.com and your reservations and purchases through PhoenX. Our Privacy Policy, Shipping Policy, and Return and Refund Policy provide additional information about how we operate.
LAUNCH RESERVATIONS
Launch reservations are free expressions of interest. No payment is collected, and a reservation is not a paid order, purchase contract, or guarantee of inventory, launch pricing, delivery date, or priority placement.
You may withdraw your reservation by contacting wearphoenx@gmail.com. You may unsubscribe from marketing emails using the unsubscribe link provided in those messages.
Kickstarter launch campaign
Our Launch Edition campaign is scheduled for November 11, 2026 at 11 a.m. Central. The limited-edition back graphic will be available exclusively through this Kickstarter campaign. Following the campaign or submitting a free website reservation does not create a pledge, secure a reward or guarantee availability. To back the campaign, you must pledge on Kickstarter once it is live.
Kickstarter pledges are separate from Shopify website orders. Pledges, collection of funds, reward details, estimated delivery, cancellations and refunds are governed by Kickstarter's terms and the campaign's published information, together with applicable law. Review those details before pledging. Crowdfunding involves project risks, and estimated reward delivery dates are not guaranteed. PhoenX remains responsible for its creator commitments and will communicate material changes through campaign updates.
PRODUCT INFORMATION AND PRICING
Please review the product description, measurements, logo, color and size before purchasing. Screen settings and production processes can affect how colors and decoration appear. These variations do not excuse supplying a defective, incorrect or materially misdescribed product.
Product availability and prices may change before you place a paid order. Applicable shipping charges and taxes will be displayed before payment.
PAID ORDERS
When paid ordering opens, customers must provide accurate contact, shipping and payment information. If we cannot fulfill an order, or discover a material pricing or description error, we will contact the customer rather than impose a changed price or substitute without consent. Any payment collected for an order we cancel will be refunded.
Made-to-order production
Website merchandise is made to order through production and fulfillment partners. Production and shipping estimates will be disclosed before paid ordering opens; production time and carrier transit time are separate. If we cannot ship a website order within the stated timeframe, we will notify you and provide delay-consent or cancellation and refund options required by law. Contact us promptly for order changes; changes may not be possible after production begins.
SHIPPING, RETURNS AND REFUNDS
Our Shipping Policy and Return and Refund Policy explain fulfillment, returns and available remedies. Restrictions on routine returns do not remove rights that apply to defective goods, unfulfilled orders or other circumstances protected by law.
OUR COMMUNITY MISSION
PhoenX allocates 10% of the merchandise price actually paid after discounts, before tax and shipping, to the Stability Fund. Production costs and payment fees do not reduce that percentage. A $66 merchandise purchase contributes $6.60. Merchandise refunds reduce the corresponding allocation by 10% of the merchandise amount refunded. The running total reports allocations, not money already distributed. Distribution updates will identify the receiving organization, date, amount and purpose. Kickstarter merchandise allocations will be recorded separately after campaign funds are successfully collected, using the merchandise portion of collected pledges before tax and shipping. Uncollected pledges and optional support without merchandise are not included in that calculation. A reservation does not generate a contribution. Purchasing merchandise does not guarantee assistance to a particular person or organization.
WEBSITE USE AND CONTENT
Do not use this website for fraud, unlawful activity, harassment or interference with its operation.
PhoenX branding, designs and original website content may not be copied or commercially used without permission, except where applicable law permits it.
PRIVACY AND CONSUMER RIGHTS
Our Privacy Policy explains how personal information is handled. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.
UPDATES AND CONTACT
We may update these terms for future website use and transactions. Updates do not retroactively remove rights associated with an existing order.
